Terms and Conditions
These terms and conditions are entered into by and between ATLAS FIT LLC (hereinafter: “ATLAS FIT”) and You (hereinafter: “the Member”).
The membership entitles the usage of the ATLAS FIT facilities, equipment, & services available therein. The membership gives access to our Tallahassee, FL. location (603 W. Gaines St. #1 Tallahassee, FL. 32304.)
The membership is personal, and cannot be shared.
The Member confirms that he/she is 18 years of age or older. For persons under the age of 18, exceptions may be granted based on written parental consent.
The Member confirms that he/she does not suffer from any health problems that would hinder exercise or prevent him/her from engaging in exercise, or that would be detrimental or adverse to the Member’s health, safety or physical condition if he/she did exercise. In case of any doubt, the Member shall seek advice by a medical doctor who should confirm the ability to exercise. ATLAS FIT shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition. If an assessment is done at ATLAS FIT, it is for the sole purpose of compiling comparative data in order to track the Member’s progress in a workout program and not for diagnostic purposes.
The Member confirms that he/she holds the necessary insurances to cover any accident or training incident. ATLAS FIT shall not be subject to any claim, demand, or injury whatsoever with regard to the assessment of the Member’s health condition or for any injury arising out of the Member’s disability, impairment or ailment.
Each Member of ATLAS FIT shall be liable for any property damage and/or personal injury caused by the Member at the ATLAS FIT premises. It shall be the obligation of the Member to pay for any costs involved upon presentation of a statement thereof.
Waiver of Liability:
Any use of the ATLAS FIT shall be at Member’s own risk at all times. The Member shall not utilize the machines unless he/she knows the correct usage of the training device. ATLAS FIT shall not be liable for any injuries, physical impact or damages to the Member, or the property of the Member, or be subject to any claim arising out of the use of the premises and/or of the machines made available to the users.
Cubbies for Personal Belongings:
Cubbies are available for Members while working out in the facility. Each Member needs to empty the cubby when leaving the facility. ATLAS FIT will empty cubbies if the Member is not in the facility. ATLAS FIT does not take responsibility for loss or theft of these personal belongings.
Lost Property or Theft:
ATLAS FIT does not take responsibility for loss or theft of any personal belongings. Any items left in ATLAS FIT premises will be kept for a period of 2 weeks.
Use of the Facilities:
The facility shall be used for training purposes only. No other activity will be allowed, and violations will be sanctioned. For example, sleeping and lingering are not allowed. Consumption of alcohol, tobacco or illegal substances is not allowed. Working out under the influence is not allowed. Conducting business or paid services is not allowed.
Code of Conduct:
The Member shall respect the behavioral and operating principles and follow them on all occasions. This includes, but is not limited to:
- Wearing proper athletic attire and shoes. No boots or open-toed shoes allowed.
- Using a towel during every workout and leaving machines/surfaces clean after each usage.
- Always leaving the cubbies empty.
- Never allowing entrance into the ATLAS FIT facility to anyone else that is not currently an active member.
- Behaving in a friendly and respectful manner towards the other members in the gym as well as the staff.
Suspension/Termination of Membership:
If the Member behaves in a way that breaches the code of conduct, interferes or disturbs other members or staff, or that the management considers inappropriate, the membership can be suspended or terminated at management’s sole discretion. If the Member does not pay the membership fees, the membership can be suspended or terminated at management’s sole discretion. The payment duty remains until the original contract period ends. The member does have the opportunity to suspend their account for up to two months with proper written requests. This suspension will allow them to stay in our system, but they will not be charged until the date of their return. The date of return must be announced at the time of suspension.
Access & Security:
ATLAS FIT is open (6AM-10PM Mon.-Thurs. / 8AM-8PM Fri. / 8AM-4PM Sat.) unless for very special reasons. The Member agrees to camera surveillance in the ATLAS FIT facilities, where the data will be stored for 7 days, then deleted. An Active Member guarantees to never let a Non-Active Member into the ATLAS FIT premises no matter the circumstances.
The Member is responsible for the payment of the membership. This is true even if the amount is debited directly by ATLAS FIT. Agreed price only applies if the Member paid according to the agreed conditions. All online memberships will be a recurring payment until the member decides to cancel their account.
Annual membership (12 months): the full amount is paid at the point of signup for this agreement. No refunds for early termination of this agreement will be granted.
Monthly membership (1 month): the 1st month’s payment is paid at the point of signup for this agreement. If the Member wishes to extend the membership, the Member simply must pay for the next month before the current month expires. If the Member doesn’t pay, the membership will stop at the end of the last paid month, after which the contract is annulled.
Guest Fees: Day passes for open gym are $10 per day for use of our facility. Day passes for personal (or) group training will be negotiated between the trainer and client. The guest will pay a $10-day pass for each day they use the facility. If they decide to join, the $10 fee will go towards their first month’s membership fee. Any active member that refuses to report their guest upon entry may be charged a day fee of $10 on top of their membership fees. This fee will be charged without any notifications to the member. Please report your guests upon entry to the facility each time you bring a guest with you.
Start Date & Duration:
The start date of the membership is specified during the sign-up. Annual memberships are valid 1 year from the start date. Monthly memberships are valid 1 month from the start date.
During 2 days from the start of the membership, the Member can cancel his/her membership free of charge, and will be reimbursed in full. Any refunds will take up to 30 days to process.
Renewals, Refunds, & Cancellations:
Annual membership (12 months pre-paid): This agreement is paid in full with no refunds or early termination capabilities. It runs for 12 months. At the end of the contract period, the membership is automatically renewed for another 12 months unless the member sends a cancellation email to firstname.lastname@example.org (or) follows the cancellation process through the website www.atlasfit.co. The member is responsible for their own cancellation, even if the email reminder was not received. The Atlas Fit staff will not be held responsible for cancellations on the member’s behalf.
Monthly membership (1 month): the membership extension is triggered by the payment of a subsequent month. If no payment is received, the membership stops at the end of the contracted month until the member resolves the payment issue. Cancellations of membership will take immediate effect at time of cancellation and access to the gym will be revoked effective immediately. For cancellations, the Member can send an email to email@example.com (or) log into their own account at www.atlasfit.co and follow the cancellation process through the website.
All prices are fixed for the duration of the contract. A price change can be implemented for the prolongation of a contract. In such cases the price change is communicated via email 1 month before the effective date.
It is possible to suspend the membership due to i) medical reasons, upon presentation of a medical certificate, ii) military service upon presentation of the official call to duty, or iii) the member has a month to month membership with ATLAS FIT. The membership can be suspended for 1-2 months (9 months for pregnancy), and is automatically activated once the period ends. The membership cannot be frozen in retrospect.
An active membership may be transferred under special circumstances and after the approval of the manager of ATLAS FIT. To complete the transfer, the departing member needs to share the intent and identify the new member. The new member needs to accept the Terms & Conditions, and then takes over the membership with the same conditions as per the original contract. It’s up to the departing member to find the new member.
Court of Jurisdiction and Applicable Law
These Terms and Conditions and all matters arising out of or relating to the access to the Member’s use of the ATLAS FIT premises and training devices shall be governed by the substantive laws of the state of Florida, without regards to principle of conflicts of laws thereof. Any controversy, claim or dispute between the Member and ATLAS FIT arising out of or relating to these Terms and Conditions and/or the Member’s use of the ATLAS FIT premises and training devices shall be subject to the exclusive jurisdiction to the ordinary courts of the seat of the Company.
